PLEASE READ OUR TERMS & CONDITIONS CAREFULLY BEFORE USING OUR SERVICES. THE USE OF OUR SERVICES SHALL BE DEEMED AN IMPLIED ACCEPTANCE OF THE SAID TERMS & CONDITIONS. 

TERMS & CONDITIONS 

These Terms & Conditions constitute the agreement between you (“User” or “you”) and Ilik Telehealth Services LLC (“Ilik”, “we” or “us”, as the context may be) and the basis on which we will provide you with and you will use our services.   

Who we are 

Ilik is a limited liability company registered with Department of Economic Development in Dubai (Professional License Number 1192525) and licensed by the Dubai Health Authority-DHA (DHA License Number 8139739). Our registered address is at 532 Sahaa Offices, Block B, Downtown Dubai, United Arab Emirates. 

Our services & products 

  1. ilik provides access to customized skincare and haircare treatment plans by connecting patients to licensed physicians through asynchronous tele-dermatology services. Our services are focused on treating the following conditions: acne, hyperpigmentation, skin aging, rosacea, and hair loss. We do not treat any other skin conditions such as skin cancer. Through our services, we may prescribe medications or customized prescription products by connecting the patient with a pharmacy or licensed compounding pharmacy but a prescription is not guaranteed. 
  2. To provide our services, ilik collects a variety of information including but not limited to personal information, contact information, medical history (medical condition, medications, allergies, prescriptions, symptoms and any other health-related information), commercial information (order and shipping history) and visual electronic information such as high resolution photographs for purposes of diagnosis and treatment. A dermatologist will review this information and decide on a treatment plan, if the patient is eligible. If appropriate, the dermatologist may also prescribe medications provided by third party pharmacies. Our services also include customer care for any follow-up questions or concerns. 
  3. Our services are delivered from Dubai, UAE. However, the treating physician might be offering their consultation from multiple locations. 

Our doctors

Our medical services are all provided by DHA licensed physicians and medical practitioners. You may check the details of our physicians and medical practitioners on our website. 

Our partners

We partner with third parties to offer you the best quality and timely service. We use third party providers to prepare, compound and deliver your own customized Ilik products and/or any other medication that your physician might prescribe.   

Certain services provided by third parties might be subject to such third parties’ own terms and conditions. You shall accept such terms and conditions to avail these services.

Our restrictions

Our services are subject to multiple restrictions, including without limitation:

  1. Our services are limited to dermatology services.
  2. Our services are not meant to include any emergency services. In case of emergency, please visit the nearest hospital or clinic. 
  3. We might not be able to offer the services in certain geographies for regulatory or other reasons. 
  4. Our services and operating model might not be suitable to diagnose and treat your medical condition. This will be assessed based on our medical practitioners’ sole professional judgement. 
  5. Our services are intended to be used by for use only by users who are at least 18 years of age. 

Our website, application, social media accounts

  1. Our website, application, social media accounts, including any content or information contained therein, is provided “as is,” with all faults, with no representations or warranties of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, quality of information, quiet enjoyment, and title/non-infringement. We do not warrant the accuracy, completeness or timeliness of the information obtained through our website, application and/or social media accounts.
  2. Unless otherwise specified, any information provided on our website, application, social media accounts or in any communication we send is intended to be for general informational and health educational purposes only. We shall not be liable for such information in any way whatsoever. Reliance on such any information is solely at your own risk.
  3. You shall not use our website, application, social media accounts, to violate any applicable laws, distribute viruses or harmful computer code, or attempt to disassemble or reverse engineer any software or information technology. You also agree to not engage in any abusive, inappropriate or unlawful behavior or language when posting on our website, application, social media accounts and when communicating with us, our physicians and employees or contractors. 
  4.  Where our website, application, social media accounts contain links to other websites, applications, social media accounts and/or resources provided by third parties, these links are provided for your information only. We are not responsible for and we shall not be deemed as approving any such links, websites, applications, social media accounts and/or resources and their content.  
  5. Our website, application and social media accounts may include views, information and/or materials uploaded by other users. Such views, information and/or materials are not verified or approved by us and do not necessarily represent our views or values.
  6. Any content you upload to our website, application and social media accounts will be considered non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us a limited license to use, store and copy that content and to distribute and make it available to third parties. We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you constitutes a violation of their intellectual property rights, or of their right to privacy.
  7. We have the right to remove any content you upload to our website, application and social media accounts if, in our opinion, your post does not comply with the content standards.
  8. You may link to our website, application and social media accounts, provided you do so in a way that is fair and legal, compliant with our content standard and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. We reserve the right to disconnect the linking or withdraw linking permission without notice. 
  9. You must not misuse our website, application and/or social media accounts in any way whatsoever, including, without limitation, by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorized access to our website, application and/or social media accounts in addition to the server on which our website and/or application is stored or any server, computer or database connected to our website and/or application. You must not attack our website and/or application via a denial-of-service attack or a distributed denial-of service attack. 

Your account

  1. You must create an account with us on our website or application to avail our services. 
  2. Each account is identified by a unique email address. You agree to create your account accurately and truthfully, including but not limited to your email address, name, mobile telephone number, date of birth and password, and that such personal details are kept up to date.
  3. You must not disclose your account information (e.g. log in info and password) to anyone. Please let us know immediately if you believe that any person got access to your account information. 
  4. We recommend that you do not access the account on public computers. We also recommend that you do not store your password through your web browser or other software, and that you provide a complex alphanumeric password as your access details.
  5. You agree and undertake to provide us and fill your account with true and accurate information, including health information, and to timely update such information. 
  6. Your account details are personal to you and you are solely responsible for maintaining their confidentiality, as you remain liable for all activity that occurs under and through your account.
  7.  You agree to prohibit anyone else from using your account and that you will only use your own account to communicate with us and avail our services. You agree that you are only communicating with us and availing our services using your own account and personal details.
  8. We aim to reconcile duplicate member accounts. If we identify multiple accounts owned by the same User, we will automatically combine the accounts. You will be informed of this by email. It is your responsibility to inform us of any duplicate accounts by contacting us at +9714 427 2100.
  9. We have the right to disable any account, at any time, if in our reasonable opinion, the User failed to comply with any of the provisions of these Terms & Conditions. 

Group & Corporate subscriptions

  1. You might get access to our services through a group or corporate subscription. For example, your employer, bank or other entities might be offering you access to our services as part of your employment, bank services etc., as applicable. 
  2. In such case:
    1. to avail our services, you will still be required to register and create an account on our website or application, accept our Terms & Conditions and you might still be required to provide us with your payment details (credit or debit card details etc.);
    2. the duration, scope, and terms of our services might be affected by the terms of our agreement with your corporate subscription provider (i.e. bank, employer, etc.); 
    3. we do not guarantee your corporate subscription provider (i.e. bank, employer, etc.) has gained your consent for us to contact you about our services. 
  3. We will never share your health and medical data with your corporate subscription provider. 

Disclaimers

In addition to any other express or implied disclaimer included in these Terms & Conditions (or in any of our communications), kindly note:

  1. We cannot guarantee that the fees you pay for our services or products are or will be covered under your health or other insurance plan. 
  2. We do not recommend and refer to a specific medical provider or practitioner. However, in the event we or our medical practitioner refers you to any specific medical provider or practitioner, we and our medical practitioner do not guarantee the availability and quality of care and shall not be liable in any way whatsoever for the services and products provided by such medical provider or practitioner.
  3. We do not guarantee that access to or use of our website, application and/or services in general will be uninterrupted or error-free or that defects in our website and/or application be corrected..
  4. We make every effort to ensure consultations maintain a viable internet connection, but we are not responsible for the internet or data bandwidth and signal of your mobile or IT device, nor transmission errors.
  5. You assume total responsibility and risk for your use of our website, application and linked websites. We do not guarantee that our website, application, downloadable files, and linked websites will be secure or free from of viruses, worms, trojan horses or other destructive programming. You are responsible for configuring your information technology, computer programs and platform to satisfy your needs for data back up and security.
  6. We do not guarantee that our website and/or application, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our website and/or application for any reason. We do not guarantee refunds for disrupted services.
  7. We will not be responsible for any service we provide to any third person who used your account to avail our services. We will not be responsible for any services we provide you while you are using a third person’s account.
  8. Our diagnosis, treatment plan, services and products prescribed are based on the information and data you provide us and your medical history data we have. Therefore:
    1. We will not be liable for any diagnosis, treatment, service and/or product we provide based or wrong, false, incomplete, inaccurate and/or not updated information; and
    2. We will not be liable if we decline to offer you our services if we believe the information you have provided us is insufficient to allow us to provide you with good quality care. 
    3. We are not liable for services provided by third parties. Therefore, and without limitation, we shall not be liable for any for unavailability or substitution of medicines, inaccurate or incomplete fulfilment of prescription, inaccurate declaration of prices, delay in delivery, inappropriate use of personal data, or any other issues or concerns related to product or medication delivery after submission of the order.
    4. The services and products we provide you are tailored based on your personal and medical needs. You shall not share our products with any other persons. We will not be liable in any way whatsoever for any use of our services and/or products by any third person. 
    5. In this section “we” shall include our staff and medical practitioners. 

 

Data protection

We take data protection, privacy and security seriously. We aim to ensure that your personal data, including your health data, is collected, processed, stored and exchanged in a safe and legitimate way. Please read and accept our Privacy Policy where you can learn more about how we handle your data.  

Promotions, Vouchers, Competitions and Prize Draws

  1. From time to time we may run and/or offer promotions (including via vouchers, promo codes etc.) competitions, free prize draws and/or other promotions (“Promotional Events”).  Any such Promotional Event will be subject to additional terms and conditions that will be made available at the relevant time.
  2. Conduct of the entire Promotional Event, including without limitation decisions on the terms and conditions, the eligibility of persons to participate, the duration of the Promotional Event and validity of entry and prizes, shall be at our sole discretion.
  3. Any tax liability or implication which attaches to a prize is the responsibility of the winner claiming that prize.
  4. We reserve the right to take reasonable action against any fraudulent or invalid redemptions of discounts, vouchers or codes, or/and participation in a Promotional Event. 
  5. We are not responsible for any loss, damage or injury suffered or claimed (including, but not limited to, indirect or consequential loss or damage, personal injury or death, and direct or indirect loss or damage) by an entrant in relation to entering or participating in any Promotional Event or taking or using the promotions, offers, vouchers and/or prizes offered except where that loss, damage or injury was caused by willful misconduct and gross negligence. 
  6. We reserve the right to cancel or change the Promotional Event if we can no longer continue the Promotional Event as offered. 
  7. Unless otherwise stated, promo codes, vouchers, prizes and anything of value offered in the course of a Promotional Event shall not be redeemed in cash, returned or exchanged. 

 

Communications & Complaints

  1. You agree that we may send to you any notices regarding our services and products through electronic means including but not limited to e-mail, mobile text message, push notifications on your mobile device, or communications posted on our website and/or application. Any of the aforementioned notices is effective when sent by us, regardless of whether you receive or read it.
  2. We reserve the right to maintain or destroy any and all communications with you pursuant to our Privacy Policy.
  3. If you have any complaint about our services pr products, please send us an email at support@ilikhealth.com or call us on +9714 427 2100. We will promptly investigate, review your complaint and communicate our decision to you. If you believe our decision is not satisfactory, you may reach out to the Dubai Health Authority by contacting 800 342. 

 

Intellectual Properties 

  1. Our services and products may include intellectual property that we or third parties own, such as, without limitation, copyrights, logos, trademarks etc. You shall not use, alter, copy or deal in any way whatsoever with such intellectual property without our prior written authorization.
  2. Ownership of all such intellectual property rights shall remain with us or the relevant third party. Such ownership shall always be respected, uninfringed, acknowledged and recognized. 
  3. You can use our website, application and social media counts for personal use only. You shall not use them or their content for commercial purposes in any way whatsoever. 

 

General terms

a. Force Majeure

In certain events such as, without limitation, acts of God, terrorism, war, invasion, failures of any public networks, cyber-attacks, electrical shortages, earthquakes or floods, civil disorder, strikes, fire or other disaster, we will not be able to offer our services and/or honor our obligations under the present Terms & Conditions. In such cases, we shall not be deemed to be in breach of our obligations towards you. 

b. Dispute Resolution and Governing Law

The Terms & Conditions and our services shall be governed by the laws of Dubai, U.A.E.  Any dispute arising out of or in connection with the Terms & Conditions and/or our services shall be referred to and finally resolved by the Courts of Dubai, United Arab Emirates.

c. Changes to our Terms & Conditions 

We may amend our Terms & Conditions from time to time. When we do so, and when such amendments are material, we will ask you to accept our updated and amended Terms & Conditions. 

d. Interpretation

To the extent that a situation or issue arises for which these Terms & Conditions make no provision or in relation to which the relevant terms and conditions are unclear, we reserve the right to make a decision regarding such situation or issue.

e. Termination

 You may end your registration, subscription, and/or the use of our services based on the terms of the subscription/package you have opted for.

 We may suspend or terminate your use of our services for any reason. In the event of termination, we will cease to offer our services to you. Based on the terms of your package/subscription, we might refund you part of or the entire amount you paid us.
